Keeping the Dealer Honest

Under the law in most States, a contract to purchase an automobile must be in writing. (The Uniform Commercial Code requires that sales of goods in excess of $500 be in writing). That being said, any agreements, promises, statements that you plan on relying upon, reassurances, etc. should be put in writing before you take delivery of your next vehicle.

But what happens if the dealer is promising you something - where do you write it down? Most dealers will use a "We Owe" form to list any additional promises that must be performed for that specific transaction.

If you were promised floor mats, an extra key, the later installation of a radio or sun roof ... anything that has not been performed at the time of delivery must be written on this form; otherwise the dealer may take the position that all the terms were satisfied at the time of delivery.

So a word to the wise, if you think you are entitled to something that you are not receiving make sure it's listed on the We Owe form.
